By downloading, installing, and using the Q.rate mobile application (the "App"), you are entering into a binding contract with Q.rate. You agree to be bound by these Terms and Conditions and accept all legal consequences. If you do not agree to these terms, do not download or use the App.

2. Description of Service

​

Q.rate is an artificial intelligence-powered music curation application that integrates with Apple Music. The App generates playlists based on user-defined prompts. Full functionality of the App requires an active subscription to Apple Music. Q.rate does not provide the music itself but creates playlists of music available on Apple Music.

3. User Responsibilities

​

As a user, you are responsible for all activity that occurs under your account. You agree to immediately notify Q.rate of any unauthorized use of your account or any other breach of security. You also agree to provide accurate and complete information when creating your account and to keep this information up to date.

4. In-App Purchases

​

The App offers in-app purchases of Q.rate tokens. These tokens can be used within the App to generate playlists. The cost for Q.rate tokens is as follows: $1.99 for 15 tokens and $2.99 for 40 tokens. Payment for in-app purchases will be charged to your Apple ID account at the confirmation of purchase. All sales are final, and there shall be no refunds or credits for unused tokens.

5. Use of AI

​

Q.rate uses artificial intelligence technology from OpenAI to generate playlist suggestions and song descriptions. These AI-generated suggestions and descriptions are not guaranteed to be accurate and may not always meet user expectations. Q.rate is not liable for any errors or inaccuracies in the AI-generated content.

6. Intellectual Property

​

All intellectual property rights in and to the App, its content, and its technology are owned by Q.rate. These rights are protected by laws and treaties around the world. All such rights are reserved. You may not copy, reproduce, republish, download, post, broadcast, transmit, make available to the public, or otherwise use any content owned by Q.rate in any way except for your own personal, non-commercial use.

7. Termination

Q.rate reserves the right to terminate your access to the App without prior notice for any reason, including, without limitation, your breach of these Terms and Conditions. Upon termination, all rights granted to you under these Terms and Conditions will immediately cease.

8. Changes to Terms

​

Q.rate reserves the right, at its discretion, to change, modify, add, or remove portions of these Terms and Conditions at any time. If the Terms and Conditions are changed, Q.rate will provide notice of the changes, such as by sending a notification, posting a notice on the App, or updating the "Last Updated" date at the bottom of these Terms. Your continued use of the App after the changes are made signifies your acceptance of the new Terms.

9. Sharing and User-Generated Content

The App allows you to share generated playlists via various platforms (e.g., email, text message, Twitter, etc.). When sharing content, you agree to abide by these Terms and Conditions and the rules of the platform you're sharing on. You are solely responsible for the content you share and the consequences thereof. You agree that you will not share any content that is illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, invasive of another's privacy, hateful, or racially, ethnically, or otherwise objectionable. Q.rate is not responsible for any user-generated content or any content shared through the App. While Q.rate uses artificial intelligence technology to generate playlists and associated descriptions, it does not control or take responsibility for user actions or the content users may share.
